It happens more often than you would think, but it's really only a problem if you've invested a lot of time and money in something. Generally, that's when corporations are most likely to send you an “it has come to our attention” letter, but now it could happen to anybody, even the small film-maker or amateur blogger, thanks to the filament-like sensors creeping through the internet like worms in fish.
A good website for this is Chilling Effects Clearinghouse, a joint project of EFF and several law schools.
